The following service terms (the “Terms”) govern your access to and use of the Learn from Fiverr platform (“Learn from Fiverr” or the “Site”), owned and operated by Fiverr International Ltd. (“Fiverr”, also referred to as “we”).
Please read these Terms carefully before you start using Learn from Fiverr. By using Learn from Fiverr you accept and agree to be bound and abide by the Terms and our Privacy Policy, found here, incorporated herein by reference. If you do not want to agree to these Terms or the Privacy Policy, you must not access or use the Site. These Terms are supplemental to Fiverr.com’s general terms of service, found here (the: “Terms of Service”), which also apply to Learn from Fiverr.
Learn from Fiverr is a marketplace for online courses in various fields (the “Courses”), available solely to Fiverr users. All Courses are made and delivered by independent instructors (the “Instructors”). Fiverr is not responsible for the content, quality or the level of the Courses or for any content or service provided by the Instructors, and does not warrant or guarantee the quality, accuracy or completeness of the Courses and/or any information provided by the Instructors. We encourage users to take advantage of our rating system in choosing appropriate Course offers.
As a marketplace, we do not inspect the Courses for legal issues nor evaluate the legality of the Courses’ content. Your use of a Course, its content and any associated items obtained through the Site is at your own risk. You assume full responsibility for actions you take following your use of a Course.
Copyright Infringement. Instructors warrant that any content included in their Courses are original work conceived by the Instructors and shall not infringe any third party rights, including, without limitation, copyrights, trademarks or service marks. In the event that certain music or stock-footage media are incorporated within the Courses, Instructors represent and warrant that they hold a valid license to use such music and/or footage and to include them in the Courses.
Fiverr will respond to clear and complete notices of alleged copyright or trademark infringement. Our Intellectual Property claims procedures can be reviewed here.
Third Party Websites. Courses on Learn from Fiverr may include links or referrals to other websites that Fiverr does not own or control. If you decide to access any third party websites and make use of the information and services contained on them, you do so at your own risk. Fiverr accepts no liability for damage or loss, however caused in connection with the use of or reliance on any information, material, products or services contained on or accessed through any third party. Users are advised to review carefully the terms and conditions provided by each service provider for the use of their services.
License. When you register to a Course, the Instructors grant you a limited, non-transferable right to view the Course and its collateral materials for your personal, non-commercial purposes. You may not distribute, transmit, assign, sell, broadcast, rent, share, modify, create derivative works of, or otherwise transfer or use the Course.
The License provided for each Course is valid for a minimum period of 1 year from the purchase date. However, we reserve the right to revoke licenses earlier on behalf of the Instructors in the event that we are required to do so for legal or policy reasons (if the Course is subject to a copyright claim for example). Your License may be terminated immediately if we determine that you are in breach of these Terms or of our general Terms of Service. We also reserve the right to extend your access rights to the Course after the said 1 year period, subject to our sole discretion.
Payment. Courses are paid for in advance. You may purchase a Course using a Credit Card only. For all other payment terms please read the purchasing section in our Terms of Service, found here. You may be charged with indirect taxes (such as sales tax, VAT or GST) depending on your residency, location and any applicable law, in addition to the Course price shown on the Course page.
Refunds. For whatever reason, if you are unhappy with a Course, please let us know through the Contact Us page. If you decide to stop learning a specific Course, you can ask for a refund within 30 days from the day of purchase.
Please Note: If you have completed the Course you will not be eligible for a refund. Also, users who purchase and refund multiple Courses may be subject to suspension for abuse of the refund policy.
The refund process usually takes 5-10 business days, depending on your financial institution, however in some cases, refunds may take up to 30 days to appear in your account. If it has been more than 10 business days since the refund was processed by Learn from Fiverr, please contact your bank directly to inquire about the status of the refund.
If you purchased a program of multiple Courses, you can ask for refunds for uncompleted Courses only, subject to the terms described above. In such cases, the refund amount will be the Program’s total price minus the completed Courses’ full price (regardless of the discount given for those Courses as part of the program).
Early Bird Discounts. Fiverr may offer Early Bird Discounts - i.e. special offers for new and exciting Courses on the Site. Where such Early Bird Discounts are available, you may be eligible for a discount on the purchase price if you pre-register for a Course. Once the Course goes live, Early Bird prices will no longer be available. Discount offers are time-limited and may expire at any time without further notice.
Promo Codes. From time to time we may offer you promo codes to be used for purchasing Courses and programs on the Site on special discounts. To exercise your promo code, simply enter the code in the checkout page. If you fail to do so, your purchase will not be eligible for the discount. The discount will be applied to the entire order as a whole. Promo Codes may not be used or combined with any other promotion. Promo codes are subject to different time limitations and will expire after their predefined term. Promo codes serve only as an incentive to use Learn from Fiverr, and, therefore, are not redeemable for cash, have no cash value and are nonrefundable. Promo codes may be subject to additional conditions and restrictions as will be disclosed to you upon receipt of the promo codes. Promo codes may be voided in the event of fraud, misuse, or violation of these Terms. Fiverr reserves the right to modify or cancel promo codes at any time. If you or Fiverr deactivate or suspend your Fiverr account, any unused promo codes will be forfeited.
Course Badges and benefits. Upon Successful Completion of certain Courses, a course badge will appear in your Seller page, indicating you have successfully complete that certain Course. The badge will remain visible on your Seller page.
For this purpose, a “Successful Completion” of a Course means that you genuinely viewed all the video content, completed all the exercises of the Course and independently completed the Course final exam and/or quizzes.
Disclaimer of Warranties
THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER FIVERR NOR ANY PERSON ASSOCIATED WITH FIVERR MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY OR AVAILABILITY OF THE WEBSITE. THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
Limitation on Liability
IN NO EVENT WILL FIVERR, ITS AFFILIATES OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE WEBSITE OR SUCH OTHER WEBSITES OR ANY COURSES OR ITEMS OBTAINED THROUGH THE WEBSITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE.
THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
We reserve the right to suspend your account should we notice any activity we determine fraudulent or inappropriate.
Users who are suspended from Fiverr due to violation of our Terms of Service cannot access Learn from Fiverr and cannot continue learning their Courses on the Site. In such cases, all refund requests will be denied.
We may make changes to these Terms from time to time. When these changes are made, we will make a new copy of the Terms available on this page.
You understand and agree that if you use the Site after the date on which the Terms have changed, we will treat your use as acceptance of the updated Terms.
We reserve the right to close or suspend the Site and/or the Learn from Fiverr platform (including the badges and related benefits) at any time without notice.
